Affidavit of Power of Attorney

This is an example of a document I personally would never use.  For one thing it’s for “power of attorney” which means that another person has granted you the full rights to operate under their legal name and for all intents and purposes to be the person granting power of attorney.  Second, I wouldn’t use it because power of attorney is done by sworn documents such as I have for my common-law partner.  If I need to use that Power I must produce the sworn documents provided by my partner granting me Power of Attorney (POA).

I was granted power by her when she was in the hospital after technically dieing and was unable to pay her bills or settle her financial matters.  When I used that POA to settle matters for her no one ever accepted my word that I had those powers.  They all wanted to see the signed authorization by the grantor of the use of the name regarding the matters I was attempting to settle.

I post this here so you can see and learn to differentiate from good paperwork and bad paperwork.  You should NEVER trust anything you read or watch online unless there is factual evidence that the claims made are valid.   I have this because someone online sent it to me as I would never attempt to produce this in a court or financial institution as it would never be accepted.

 

AFFIDAVIT OF POWER OF ATTORNEY

A true copy of the Power of Attorney that was granted to me by ___________________ on the _________ day of ____________, __________________ is annexed hereto and is in full force and effect. I had no knowledge of or notice of the revocation or termination of the Power of Attorney by death or otherwise at the time of execution of ______________________ [insert name of document signed as attorney] on the _________ day of __________, ______________.

This affidavit is made for the purpose of inducing __________________ [insert name of person or body corporate] to accept the above described instrument executed by me as attorney and knowing that by accepting the aforesaid instrument, they will rely upon this affidavit.
